2020 PITTSBURGH STEELERS DESIGN A CLEAT FOR MINKAH FITZPATRICK CONTEST OFFICIAL RULES
ENTRIES ARE FREE OF CHARGE. ONE ENTRY ALLOWED PER PERSON. NO PURCHASE NECESSARY TO ENTER. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED BY SPONSOR. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.
By participating in the 2020 Pittsburgh Steelers Design a Cleat for Minkah Fitzpatrick Contest ("Contest"), you ("you" or "Entrant") agree to these official rules ("Rules"), inclusive of all terms and conditions. Please read the Rules carefully before participating. You must strictly follow the directions provided within these Rules to be eligible to have a cleat that you design worn by Minkah Fitzpatrick in a Pittsburgh Steelers game during the 2020 National Football League ("NFL") season as part of the NFL's "My Cause My Cleats" initiative.
SPONSOR: This Contest is sponsored and administered by Pittsburgh Steelers LLC, 100 Art Rooney Avenue, Pittsburgh, PA 15212 ("Sponsor" or "Steelers").
HOW TO ENTER: The Contest will begin at 12:01 A.M. EST on September 8, 2020 and end at 11:59 PM EST on November 15, 2020 ("Promotion Period"). To enter the Contest, you must submit your original cleat design ("Design") by going to (i) https://www.steelers.com/legal/my-cause-my-cleats-terms or (ii) the Steelers mobile app, completing the online entry form, including providing your contact information and agreeing to be bound by the terms and conditions of these Rules (an "Entry"). Your Entry must include (i) an original drawing or photograph depicting the finished Design (the "Design Drawing/Photo"); and (ii) a detailed description of the cause reflected in the cleat Design. Those individuals submitting a completed Entry (the "Entrants") will be entered into the Contest as described in these Rules. All costs and expenses associated with Entrant's participation in the Contest, including any costs and expenses associated with the time necessary to develop and/or submit a Design, shall be the sole responsibility of the Entrant unless otherwise provided in these Rules.
All Design Drawing/Photos must be in .pdf, .jpg or .gif format and no larger than 3 megabytes in size. The Entrant must own all rights to the submitted Design Drawing/Photo. The Design Drawing/Photo must be original, must not include any design other than such design created and submitted by Entrant, and must not include unlawful, threatening, libelous, defamatory, indecent, obscene, violent, vulgar, pornographic or profane material, material that violates the intellectual property, privacy or other rights of third parties, or material that otherwise violates these Rules in whole or in part. In submitting the Design Drawing/Photo, each Entrant represents and warrants that the Design depicted in the Design Drawing/Photo is original, that Entrant owns the rights to the Design depicted in the Design Drawing/Photo, and that Sponsor's use of the Design and/or the Design Drawing/Photo, or any parts thereof, will not infringe upon the rights of the Entrant or any third party, including, without limitation, any intellectual property or privacy rights.
Entries must be received by the end of the Promotion Period. Limit of ONE (1) AND ONLY ONE (1) ENTRY PER PERSON. Multiple Entries received from any person beyond this limit will void all such additional entries. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted.
Failure to follow any instructions provided in these Rules may result in disqualification. The time of receipt of any valid Entry shall be the time such valid Entry becomes available to Sponsor. Sponsor's computer shall be the official clock of the Contest. Mailed Entries shall be postmarked on or before the final day of the Promotion Period to be considered. All Entrants agree that all decisions of Sponsor shall be final and binding with respect to all matters related to the Contest, and Entrants waive any right to challenge any decisions made by Sponsor and waive any right to claim any ambiguity in the Rules or any Entry.
By entering the Contest, an Entrant gives express permission to be contacted by Sponsor.
BY PROVIDING CONTACT INFORMATION, ENTRANTS CONSENT TO THE COLLECTION AND STORAGE OF THE INFORMATION PROVIDED. UNLESS THEY ELECT TO OPT-OUT, ENTRANTS TO THE CONTEST MAY RECEIVE MARKETING AND OTHER PROMOTIONAL INFORMATION FROM SPONSOR AND/OR ITS AFFILIATED PARTIES AND CONTRACTORS. ELIGIBILITY TO PARTICIPATE IN THE CONTEST IS NOT, HOWEVER, DEPENDENT UPON ENTRANT'S CONSENT TO RECEIVE SUCH MARKETING AND OTHER PROMOTIONAL INFORMATION AND YOUR CHANCES OF WINNING ARE NOT AFFECTED BY SUCH CONSENT. BY PROVIDING CONTACT INFORMATION AND NOT ELECTING TO OPT OUT, ENTRANTS CONSENT TO BEING CONTACTED BY SPONSOR AND ITS AFFILIATED PARTIES AND CONTRACTORS. CONTACT METHODS MAY INCLUDE MAILINGS, EMAILS AND TELEPHONE CALLS (INCLUDING THOSE GENERATED FROM AN AUTOMATED TELEPHONE DIALING SYSTEM) AT THE TELEPHONE NUMBER PROVIDED, INCLUDING ANY WIRELESS TELEPHONE NUMBER PROVIDED.
ELIGIBILITY: The Contest is open to (a) legal residents of the fifty (50) United States of America and the District of Columbia, who are thirteen (13) years of age or older; and (b) legal residents of Mexico who are thirteen (13) years of age or older at the time of Entry. Notwithstanding the prior sentence, this Contest is void where prohibited or restricted by law, rule or regulation. Officers, members, managers, and employees of Sponsor Entities (as defined below), members of these persons' immediate families (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Contest. "Sponsor Entities" shall mean Sponsor, the NFL, and their respective parents, subsidiaries, and affiliate companies, administrative, advertising, and promotion agencies involved with the Contest, and any other person or entity involved in the development, administration, promotion, or implementation of the Contest. The NFL is not, however, an actual Sponsor of the Contest.
WINNER:One (1) winner (the "Winner") will be chosen from the pool of eligible Entrants who have completed the required steps as of the end of the Promotion Period. The winning Design will be selected by the Sponsor in its sole and absolute discretion. Winning is subject to verification of eligibility.
PRIZE: There will be only one (1) prize awarded. More specifically, the Winner shall receive their winning Design featured on one or both of Minkah Fitzpatrick's cleats for one (1) game during the 2020 NFL season as part of the NFL's "My Cause My Cleats" annual promotion (the "Prize"). The game in which the cleats will be worn by Minkah Fitzpatrick shall be chosen in the Sponsor's sole and absolute discretion and be subject to applicable NFL rules.
NO TRANSFER OR ASSIGNMENT OF THE PRIZE: The Prize is non-transferable and non-assignable, with no cash redemption except at Sponsor's sole and absolute discretion. Odds of winning the Prize depends upon the number of eligible Entries received during the Promotion Period. Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with Winner's participation in the Contest and/or acceptance of the Prize shall be the sole responsibility of the Winner unless otherwise provided in these Rules.
NOTIFICATION: Sponsor will notify the potential Winner at the telephone number and/or email address provided in the Entry. Sponsor will make three (3) attempts to contact a potential Winner via telephone and/or email within 48 hours from the time of the Drawing in which the potential Winner was selected. If Sponsor is unable to reach a potential Winner by telephone and/or email within such 48 hour period, then that potential Winner will be disqualified and an alternate potential Prize Winner's Entry will be drawn from all remaining eligible Entries at Sponsor's sole and absolute discretion. At the time of Sponsor's contact with the potential winner, the potential Winner will be asked to provide his/her proof of age, and a government-issued photo ID. The notified eligible Winner shall be the only party eligible to claim the Prize.
If the Prize Winner declines the Prize, fails to claim the Prize, is unavailable for Prize fulfillment, fails to abide by the Rules, or is ineligible, Sponsor may select an alternate winner from all remaining eligible Entries in its sole and absolute discretion. Sponsor is not responsible for and shall not be liable for unsuccessful efforts to notify a potential Winner.
PUBLICITY AND USE RELEASE: By submission of an Entry, an Entrant grants to Sponsor, and each of its respective designees, the right to publicize and/or use such Entrant's name, address (city and state of residence), voice, statements, drawings, photograph(s) and/or other likeness(es), as well as the Entrant's Design and/or Design Drawing/Photo(s), for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation, and without further compensation, consideration, permission or notification, unless prohibited by law.
RELEASE/WAIVER OF LIABILITY: By participating in the Contest and submitting an Entry and/or accepting the Prize, each Entrant expressly agrees to (i) be bound by these Rules, including all Entry requirements, and (ii) waive, release and discharge any and all claims against Pittsburgh Steelers LLC, the NFL and each of its other member clubs and affiliates, and each of their respective parents, affiliated companies, subsidiaries, officers, directors, members, managers, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, arising out of or in any way related to the Contest, these Rules, Entrant's Entry, Entrant's Design, Entrant's Design Drawing/Photo(s), negligence of any of the Released Parties, any travel or activity related to the receipt or use of the Prize, or the acceptance, participation, use or misuse of the Prize.
Additionally, if the potential Winner is under the age of eighteen (18), or in the case of legal residents of certain American states or areas of Mexico where the legal age of majority is greater than eighteen (18) years of age, the potential Winner's parent or legal guardian must execute the "Consent, Acknowledgment of Contest's Official Rules, and Liability Release/Waiver" form attached hereto as Attachment A in order for such potential Winner be eligible to claim the Prize.
PRIVACY POLICY: Information collected in connection with the Contest will be used in accordance with Sponsor's Privacy Policy (https://www.steelers.com/legal/privacy-policy/), and these Rules. In the event of any discrepancy between Sponsor's Privacy Policy and these Rules, Sponsor's Privacy Policy shall control and govern.
GENERAL CONDITIONS: Released Parties are not responsible for late, incomplete, illegible, inaccurate, undelivered, or garbled Entries, interrupted or unavailable network or other connections; misdirected, blocked, or delayed notifications; printing, typographical or other errors appearing within these Rules, in any Contest-related advertisements or other materials; or any other errors, problems or difficulties of any kind relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of Entries, or the announcement of the Prize or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants or to any other person's computer related to or resulting from participating in this Contest. Released Parties (i) make no warranty, guaranty or representation of any kind concerning the Prize, and (ii) disclaim any express or implied warranties. Sponsor's failure to enforce any term of these Rules shall not constitute a waiver of any such term. No Entrant or Winner shall be considered an employee, agent or authorized representative of any of the Released Parties. All disputes will be resolved under the internal substantive laws of the Commonwealth of Pennsylvania, without regard to its conflicts of laws principles, and the laws of the United States. All disputes arising out of or with respect to this Contest or these Rules shall be heard exclusively in the courts, state and federal, located in Pittsburgh, Pennsylvania, USA.
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THE CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor reserves the right, in its sole discretion, to cancel or suspend the Contest at any time. In the event of cancellation, Sponsor may elect to identify the Winner and award the Prize by way of selection in Sponsor's sole and absolute discretion from among all non-suspect, eligible Entries received up to the time of such cancellation. Sponsor reserves the right, in its sole discretion, to modify these Rules for clarification purposes without materially affecting the terms and conditions of the Contest. Sponsor further reserves the right to revoke the Prize or remove an Entrant or Winner, at any time, if the Entrant or Winner acts in a manner that is, in Sponsor's sole discretion, offensive, harassing, threatening, repugnant, or violent at any time in connection with the Contest or Prize.
WINNER'S NAME: To obtain the name of the Winner, mail a request and a self-addressed stamped envelope to: 2020 Pittsburgh Steelers Design a Cleat for Minkah Fitzpatrick Contest, 100 Art Rooney Avenue, Pittsburgh, PA 15212. Requests must be received no later than March 1, 2021.
ABBREVIATED RULES: 2020 Pittsburgh Steelers Design a Cleat for Minkah Fitzpatrick Contest begins 9/8/2020 and ends 11/15/2020. Open to legal residents of the United States, District of Columbia and Mexico aged 18 years or older at time of Entry. Odds of winning depend upon the number of valid Entries received. One (1) Prize will be awarded. Contest Sponsor is Pittsburgh Steelers LLC. No purchase necessary to enter. Void where prohibited by law.
