TERMS AND CONDITIONS APPLICABLE TO PITTSBURGH STEELERS BARS SUBMISSIONS

By submitting or sharing photos, videos, logos, stories, and any other materials (hereinafter referred to as a "Submission") in connection with the Pittsburgh Steelers Bars program, you, the submitter ("You" or "Your"), agree to be bound by the following Terms and Conditions (the "Terms"):

  1. You own all rights, title and interest in the Submission as of the date of Submission. Submissions cannot defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights. If the Submission contains any material or elements that are not owned by You and/or which are subject to the rights of third parties, You are responsible for obtaining, prior to submitting the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by the Sponsor, Steelers and their respective designees, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Submission.
  2. You agree to assign all rights, title, and interest, including copyright rights, in the Submission to QB North America (the "Sponsor"), Pittsburgh Steelers LLC (the "Steelers") and grant permission for the Sponsor, the Steelers and their respective designees to publish or publicize all or part of the Submission, including, but not limited to, Your name, likeness and photo as well as the names, likenesses and photos of other parties shown in the Submission, in whole or in part, for advertising, promotional and trade or other purposes in any and all media now known or hereafter developed, worldwide in perpetuity, without notice or permission and without further compensation, except where prohibited by law.
  3. You agree to be legally bound by not only these Terms but also the Steelers' Privacy Policy contained at https://www.steelers.com/legal/privacy-policy/ and the Steelers' Terms of Use at https://www.steelers.com/legal/terms-of-use/, which are incorporated herein by reference.
  4. You acknowledge and agree as follows when providing a Submission:
  • You are at least 21 years old as of the date of Submission.
  • You have all necessary rights to the Submission.
  • You grant the Sponsor and the Steelers express consent to use the Submission, which may include Your image or likeness, for any purpose, including commercial purposes, without any compensation owed or paid to You.
  • You have the written permission of any persons or entities in the Submission, including the written consent of the parent or legal guardian of any minor child or legal ward depicted in the Submission. Such written permission from each person or entity depicted in the Submission shall include consent for the Sponsor and the Steelers to use each such person's or entity's image and likeness for any purpose, including commercial purposes.
  • The Sponsor and the Steelers may share or distribute Your Submission to any party or parties, including to the general public, at any time and for any reason whatsoever. No privacy rights or rights of publicity attach to any Submission.
  • No collaborative or third party material is permitted in the making of the Submission unless such material is in the public domain (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media).
  • Your Submission shall not include material that: (i) is sexually explicit, indecent, obscene, violent, hateful, tortuous, defamatory, slanderous or libelous, (ii) is derogatory or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, (iii) invades the privacy or publicity rights of any person, living or deceased, (iv) is unlawful, (v) is harmful to other users of www.steelers.com or any of the Steelers' official apps or social media platforms, such as viruses, Trojan horses or other technologies that could adversely impact any other user and/or (vi) is disparaging to the Sponsor or the Steelers or is inconsistent with the positive images and/or goodwill with which the Steelers wish to associate.
  1. You agree to grant the Sponsor and the Steelers a royalty-free, perpetual, irrevocable, non-exclusive and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, combine with other works, create derivative works from, distribute, perform, edit and display such Submission (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology not known or later developed. You specifically waive any "moral rights" in and to the photo or video. The foregoing includes, without limitation, any copyrights and other intellectual property rights in and to Your Submission.
  2. You represent and warrant that: (i) You own the Submission; (ii) the posting of Your Submission does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity; and (iii) the Steelers' reproduction, publishing, displaying, and/or other use of the Submission will not infringe on any right of third parties, including without limitation, copyright, trademark, privacy or publicity, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract.
  3. You acknowledge and agree that the Sponsor or the Steelers may preserve the Submission and may also disclose the Submission if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce these Terms; respond to claims that any Submission violates the rights of third parties; or protect the rights, property, or personal safety of the Steelers, its fans, and the public.
  4. You acknowledge and agree that the technical processing and transmission of Your Submission may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting to networks or devices.
  5. You acknowledge and agree that any Submission to the Sponsor and the Steelers is Your sole responsibility. You cannot assume any level of privacy, whatsoever, of any Submission to the Sponsor or the Steelers, as the Sponsor or the Steelers may share or distribute such Submission to the public at any time. As a result, the Sponsor and the Steelers cannot guarantee that other viewers will not misuse the Submission that You submit. If You have any material or information in a Submission that You would like to keep confidential and/or do not want others to see or use, do not submit it to the Steelers or the Sponsor. Under no circumstances will the Steelers be liable in any way for any Submission. THE STEELERS ARE NOT RESPONSIBLE FOR ANY MISUSE OR MISAPPROPRIATION OF ANY SUBMISSION.
  6. This promotion is sponsored by and or organized by Sponsor. By participating in this promotion, you agree that the Steelers, the National Football League ("NFL") and each of its other member clubs and affiliates, and each of their respective parents, affiliated companies, subsidiaries, officers, directors, members, managers, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Steelers, and all of their respective officers, directors, employees, agents and representatives (collectively, the "Released Parties") are not the sponsors or organizers of this promotion and you hereby agree to waive, release and discharge any and all claims against Released Parties for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, arising out of or in any way related to Your Submission, these Terms, negligence of any of the Released Parties, and any travel, activity or participation related to the Submission.
  7. You agree to indemnify and hold harmless the Released Parties from any claim, demand, action, damage, loss, cost or expense, including without limitation, reasonable attorneys' fees, incurred in connection with any suit or proceeding brought against any of the Released Parties which arises out of or in any way relates to Your Submission. 
  8. The prizes are non-transferable and non-assignable, with no cash redemption option. Taxes on or connected with the prize and any reporting consequences thereof are the sole and exclusive responsibility of winners
  9. If, for any reason the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes within or beyond the control of Sponsor which corruptor affect the administration, security, fairness, integrity, or proper conduct of the promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the promotion. Trademarks used herein, other than those of the Released Parties, are owned by Sponsor and its affiliated companies. Sponsor's decisions in respect of any matter(s) concerning a promotion are final. Sponsor may reclaim any bonus amount or enhanced payments that have been awarded in error. No employees of Sponsor and its affiliated companies, or family members of employees and affiliated companies, may take part in promotions.   10. During a select eight-week period each calendar year that the promotion is live, ten (10) randomly selected submitters will be awarded with a $500 Steelers Pro Shop Gift Card. No purchase necessary to enter. Must be 21 years old and a resident of the U.S. as of the date of Submission to be eligible to win. Winners may be required to execute and return an Affidavit of Eligibility, a Waiver and Liability Release, and where lawful, a Publicity Release, prior to delivery of the prize, but in no event later than two (2) days after notification. Failure to return documents timely, or a prize notification or prize being returned as non-deliverable, may result in disqualification with an alternate winner selected.
